NOTICE OF INTENT TO SELL PROPERTY AND REQUEST FOR BIDS FOR PURCHASE OF PROPERTY DESCRIBED AS LOT 8 IN RALLES-ACRES
(9401 NW 70th Ave., Johnston, Iowa)
The City of Johnston is soliciting bids from parties interested in purchasing City-owned property legally described as:
Lot 8 in Ralles-Acres, an Official Plat now included in and forming a part of the City of Johnston, Polk County, Iowa, EXCEPT the real property described in the acquisition plat recorded in Book 19689 Page 855 of the Polk County Recorder’s Office. (locally known as 9401 NW 70th Ave.)
Bidders shall submit their bids in a sealed envelope, plainly marked “SEALED OFFER 9401 NW 70th Ave.” no later than 3:00 pm, local time, on March 19, 2024, at the reception desk at Johnston City Hall, 6221 Merle Hay Road, Johnston, Iowa.
At the above time and place, all bids received by the City will be opened and publicly read with the results being reported to the Johnston City Council at its meeting on April 1, 2024, at 7:00 p.m., at which time the Council may take action on the proposals submitted.
Property site visits/open houses are scheduled for 3:00 p.m. on Friday, February 23, 2024 and 3:00 p.m. on Friday, March 1, 2024. Bidders are strongly encouraged to attend one of the open houses to visit and tour the site. Other requests for site access will be denied.
A minimum bid amount of $250,000.00 is required. Bids submitted for less than this amount will be rejected.
Submission Requirements: The Bidder must submit an offer on the City’s bid form on or before 3:00 pm, local time, on March 19, 2024. Late bids will be returned to bidders. The Bidder shall also be required, at the time of bid submission, to submit a deposit in the amount of 5% of the proposed bid amount. The deposit must be made by certified check, treasurer’s check or cashier’s check issued by a responsible bank or trust company, payable to the City of Johnston. Deposits of unsuccessful bidders will be returned within 45 days of the bid opening.
- Award of Bid: The bid will be awarded to the highest responsive and responsible bidder complying with the conditions set forth herein, provided the bid is in the best interest of the City of Johnston. The property will be conveyed “as-is” via Quit Claim Deed, subject to all easements and encumbrances of record.
- The successful bidder will also be responsible for all of the following:
- Complying with the City of Johnston, Iowa, ordinances, codes and regulations
Purchase Agreement: The successful bidder must execute a Purchase Agreement on a form prepared and approved by the City no later than 3:00 p.m. (CST), April 5, 2024, or the successful bidder’s bid will be deemed rejected. Failure to execute the Purchase Agreement within this timeframe will result in forfeiture of the successful bidder’s deposit.
Payment for Bill of Sale: Payment of the bid price by successful bidder must be made by certified check, treasurer’s check or cashier’s check issued by a responsible bank or trust company, payable to the City of Johnston by April 29, 2024, 3:00 p.m. A wire transfer will be accepted as an alternative form of payment. If the City does not receive payment of the bid price by April 29, 2024, 3:00 p.m., then the City may, at its sole discretion, without further notification to the successful bidder, attempt to award the bid to the next highest responsive and responsible bidder. Further, failure to submit payment within this timeframe will result in forfeiture of the successful bidder’s deposit.
Failure to submit any materials or comply with the requirements of this bid proposal may result in the bid being deemed nonresponsive and rejected. The City reserves the right to reject any and/or all bids and to waive any and/or all technicalities and/or all irregularities. The bid must be signed by a person authorized to bind the bid.
